Charging

Regulation 21 (Regulation 23 in Wales) makes provisions for local authorities to charge fees for conducting certain duties under the Regulations. In England, although there is no maximum fee, the local authority can only charge a fee to recover their costs, which is the reasonable cost of carrying out the service (activity). In Wales the fee must not exceed the maximum specified in Schedule 6 of The Regulations (Wales).

The maximum fees the local authority can charge in Wales are:

(1) No fee is payable where a sample is taken and analysed solely to confirm or clarify the results of the analysis of a previous sample.
